PERSONAL DATA PROCESSING AND PROTECTION

Information statement pursuant to article 13 of Legislative Decree 196 of 30 June 2003 and General Data Protection Regulation EU 2016/679 (GDPR).

In compliance with the provisions of the above regulations, we hereby inform of the purposes and processing methods of your personal data, as well as the disclosure and dissemination of said data, the nature of the data in our possession and the provision of the data.

Purpose of Data Processing: Tecnica Srl, with head office located in Via Labirinto, 151 – 25125 Brescia (BS) – Tax ID and VAT number IT 03556160178, represented by its Pro Tempore Legal Representative, in its capacity as Data Controller, hereby informs you that the personal data provided may be processed directly or through a third party to fulfil contract obligations and to render the services (e.g. promotional newsletters, informative reports, in-depth information on products and services of Tecnica Srl or on the "production and sale of solutions, instruments and hard metal cutting tools, highly customisable” or commercial communications that may contain information, notifications, events, deals, special offers, invitations, market research surveys, catalogues, etc.), including those to fulfil provisions of law, regulations and EU standards. The provision of your personal data is mandatory to pursue the above purposes and failure, partial or inaccurate provision of said data may result in the inability to render the services offered by Tecnica Srl and its partners. Users may independently provide their personal data using the forms to access certain services. Providing the data marked with an asterisk (*) in the data collection form is required in order to give the requested information; therefore, not giving said data will result in the inability for Tecnica Srl to render said services. Data not marked with an asterisk (*) is not required. The data is processed solely for purposes associated to the service under discussion, unless notified otherwise during the registration or data entry phase for each service. The data provided when filling out the contact form can be processed for marketing purposes with prior consent: by way of example, to send deals and commercial notices on the services or products offered by Tecnica Srl and partners or to inform about corporate events, as well as market studies and statistical analysis by sending text messages, direct messages via social networks, emails or certified emails with automated contact methods or through traditional forms, such as by phone with a professional operator duly trained or by traditional post.

Online Forms for Third Parties: Requests forms (e.g. contact request forms, information request forms, registration request or online service request forms or one or more newsletter forms) can be available on the websites and services managed by Tecnica Srl and they require the entry of personal data (e.g. contact details such as name, surname, company name, email address, land line number and mobile number). By filling out said forms, the user will be registered in a database of the website, project or reference service to later receive relevant information. Said data can be forwarded electronically to the division in charge of the website, project or service thereby undertaking to use it solely for the purposes of fulfilling the requests. In subsequent phases, the user may authorise or deny the third party company to use its personal data for other purposes, such as to activate specific services. Tecnica Srl may enable the preservation and maintenance of copies of information provided in its data bases for these forms, to guarantee the quality and usability on its part and on the part of companies whose data are addressed by the user. Tecnica Srl undertakes not to disseminate this data and not to transfer it to third parties that are not related to the website, project or service. As far as data processing by the third party company to the user that addressed it through a form, its request for any notification must be made directly to the third party company. It is the user’s responsibility to check the conditions on personal data protection directly with the company responsible for the website, project or reference service.

Newsletter and Direct Email Marketing: By visiting the vortals managed by Tecnica Srl for partner facilities or dedicated to projects, services and proprietary software, users may activate, where possible, the newsletter service to receive messages via email or post to their own address, containing invitations or information about events, services, publishing articles or in-depth vertical studies regarding subjects like “Solutions, instruments and hard metal cutting tools, highly customisable", as well as market research studies. Newsletters may also include ads. Registration to the newsletter service may also take place independently by signing the dedicated form only or by activating the mobile application managed by Tecnica Srl for the respective property. The user may opt-out or unsubscribe by cancelling the authorisation to receive the newsletter at any time, directly from the newsletter using the special service links. The data of users who authorise or subscribe to receive the newsletter is not disclosed by Tecnica Srl to third parties that are unrelated to the website, project or reference service.

Data Processing Methods: Data processing includes the collection, registration, organisation, preservation over the time necessary to pursue the purposes, as well as processing, modification, selection, extraction, comparison, usage, inter-connection, blocking, communication, dissemination and cancellation or otherwise combination of two or more of said tasks. The data can be processed both manually or with the help of automated tools that are secured pursuant to the provisions of applicable laws on personal data processing. Said data is processed exclusively by persons especially assigned by Tecnica Srl or third parties related to the website, project or managed reference service. In particular, the data is processed by members of the Tecnica Srl organisation, such as managers of the commercial area, marketing managers, as well as administrative and technical staff, as far as their competence.

Scope of Disclosure and Dissemination of Personal Data: Personal data is preserved securely within the physical and virtual technological infrastructure, as well as in the Cloud server managed by Tecnica Srl or by qualified and accredited suppliers and partners. Data can be processed by employees according to their corporate duties to pursue the above mentioned purposes and who are expressly authorised to process said data and who have received the proper operating instructions to do so, but also by third parties that are related to the website, project or managed reference service. The data may be disclosed to parties in their capacity as Data Controllers (such as, supervisory authorities and any public entity entitled to request said data).

Data Source: Tecnica Srl gained possession of the personal data as the data was provided voluntarily and independently through vortals managed by the latter for partner facilities or dedicated to projects, services and proprietary software and websites managed for third parties.
Data Preservation Time: The personal data gathered is preserved until the user requests or expresses its will to unsubscribe from the service. After said term, the data held by Tecnica Srl is destroyed or made anonymous in line with technical erasure and backup procedures.

Provision of Data: The provision of data is optional. If you do not wish to receive additional information, please inform Tecnica Srl in writing or unsubscribe using the automated option located on the bottom of each communication. Obviously, if you request us to delete your data that is required to send invitations or information about our events, products, services, publishing articles and in-depth vertical studies on “Solutions, instruments and hard metal cutting tools, highly customisable”, as well market research studies, you will miss out on opportunities related to updates on our future activities. Please note that you have the right to learn about your data in our possession at any time and request for it to be updated, rectified, supplemented or erased from our database. RIGHTS OF THE DATA SUBJECT

The Data Subject may exercise all the rights envisaged in article 7 of Legislative Decree 196/03 in line with the General Data Protection Regulation EU 2016/679 (GDPR), in particular Data Subjects have the right to know about which data is present in the files and the right to erase said data.

Article 7 of Legislative Decree 196/03 states the following:

  1. Data subjects have the right to obtain confirmation of the existence or otherwise of personal data concerning them, even if not yet recorded and the communication thereof in intelligible form.
  2. Data subjects have the right to obtain information about the origin of the data; the purpose of the data processing; the logic of the data processing; identification details of the Data Controller and Data Processors; subjects to whom the data may be disclosed.
  3. Moreover, Data subjects have the right to obtain: the updating, rectification or supplementation of the gathered data; the erasure, transformation into anonymous form or blocking of data that is processed unlawfully, including data whose retention is unnecessary for the purposes for which it was collected or subsequently processed; the right to certify that the actions as per the above sections have been notified to the entities to whom or which the data was disclosed, unless this requirement proves impossible to fulfil or involves a disproportionate use of resources in relation to the right to be protected.
  4. Data Subjects shall have the right to object, in whole or in part: for legitimate reasons to the processing of personal data concerning them, even though they are relevant to the purpose of the collection; object to the processing of personal data concerning them for purposes of sending advertising materials.
Now, therefore, by contacting Tecnica Srl by post to the head office or by email to the email address info@tecnicautensili.com, Data Subjects may request the Data Controller to access the personal data concerning them, as well as request the erasure, the rectification of inaccurate data, the supplementation of incomplete data and the restriction to the processing of data in the cases envisaged in article 18 of the GDPR. Moreover, if the processing is based on a consent or contract and is carried out with automated instruments, Data Subjects have the right to obtain the personal data from the Data Controller in a structured, commonly used and machine-readable format and if technically possible, have the right to transmit those data to another controller without hindrance. Data Subjects have the right to lodge a complaint with the competent Supervisory Authority in the member state where they normally reside or work or in the country in which the alleged breach took place.

COOKIES

Cookies are packets of information sent by a web server (e.g. the website) to the user’s browser and automatically stored on the computer and then automatically sent back to the server with every subsequent access to the website.
